Dass der Designprozess bei Samsung ausschließlich darin besteht die
Konkurrenz zu "beobachten" und gute Ideen so zu übernehmen, dass man nicht
sofort merkt, dass kopiert wurde. Eigene Entwicklungen und Innovationen?
Fehlanzeige.Apple legt ein Foto von einem Samsung Handy vor, dass das
Icon-Layout Out-of-the-Box zeigen soll. Samsung beschuldigt Apple, dieses Foto
verfälscht zu haben. Die Samsung Anwälte legen dann ihrerseits ein Foto vor,
dass das wirkliche Layout zeigen soll. Die Samsung Anwälte sagen dazu, dass
das Foto an einem bestimmten Tag aufgenommen wurde. Der Richterin fällt auf,
dass auf dem Foto von Samsung das Google Such-Widget fehlt, obwohl die Samsung
Anwälte selbst gesagt haben, dass das Out-of-the-Box immer da ist. Außerdem
fällt der Richterin auf, dass das Datum auf dem Bild nicht mit dem
übereinstimmt, das die Samsung Anwälte behauptet haben. Die Samsung Anwälte
gestehen letztendlich zu, dass sie sich beim Datum "geirrt" haben. Was sie zum
fehlenden Widget gesagt haben, steht nicht im Artikel...Was ich damit sagen
will: In  Prozess gibt es bisher eher Hinweise, dass Samsung die Beweise
manipuliert und nicht Apple.  

A litigant who files an appeal, known as an “appellant,” must show that the trial court or administrative agency made a legal error that affected the decision in the case. The court of appeals makes its decision based on the record of the case established by the trial court or agency. It does not receive additional evidence or hear witnesses. The court of appeals also may review the factual findings of the trial court or agency, but typically may only overturn a decision on factual grounds if the findings were “clearly erroneous.”
